One-year imprisonment to driver in accident case

JAMMU, Nov 23: CJM Ramban Kusoom Pandita today awarded one year imprisonment and fine of Rs 5000 to driver of a vehicle namely Arshad Ahmed in an accident case.
According to the police case, on October 21, 2008 police received an information through reliable source that truck driven by Arshad Ahmed Shah, son of Ghulam Mohd Shah of Silsopora hit a pedestrian namely Surjeet Singh and fled from the spot. Accordingly, a case under Section 304-A/279 RPC was registered and after completion of investigation challan was presented in the court of law.
After hearing CPO for the State whereas Advocate I H Malik for the accused, CJM observed, “from the material available on record and after going through entire prosecution evidence it is crystal clear that the deceased died due to carelessness on part of accused. As such offence under Section 279/304-A RPC and 3/181, 6-7/177 Motor Vehicle Act is made out against the accused person”.
With these observations, the Court awarded one-year imprisonment and fine of Rs 5000 to driver.
