‘Aspirations of women fully taken care of’

JAMMU, June 24: Principal District and Sessions Judge Jammu Sanjay Parihar said today that three new Criminal Laws will come into force from July 1, 2024 which will go a long way in catering to needs of the society, giving right of hearing to accused at every stage, removing old provisions like offences of adultery, 377 and those related to Weights and Measures and taking very important steps in crime and violence against women.

Sanjay Parihar was the Resource Person for the first day today to make young Advocate aware about changes in the new Criminal Laws at New Lawyers Chamber Conference Hall.
New Criminal Laws including Bharatiya Nyaya Sanhita 2023, Bharatiya Nagrik Suraksha Sanhita 2023 and Bharatiya Sakshya Adhiniyam will replace Indian Penal Code, Code of Criminal Procedure and Indian Evidence Act which stands repealed, the Principal District and Sessions Judge Jammu said.
He said the training sessions are being organized for young Advocates to make them aware about the changes taking place in new Criminal Laws under the direction of the Chief Justice and guidance of Administrative Judge for Jammu district.
The training sessions for the young Advocates are being organized as certain inconsistencies may happen due to implementation of new Criminal Laws, he said, adding senior Advocate including Sunil Sethi, Rajesh Kotwal and Vikram Sharma have been urged to provide assistance to brief the young Advocates.
“Three new Criminal Laws would go a long way in catering to the needs of the society but by and large existing provisions in the earlier laws have been retained with minor variations. An important provision pertained to the right of hearing of accused at every stage. This has been given legal recognition. Even at the stage of taking cognizance, the accused can be heard. This is an important development,” Sanjay Parihar said.
He asserted that this will remove bogus litigation at the initial stage.
The Principal District and Sessions Judge Jammu said in Bharatiya Nyaya Sanhita, certain old provisions like offence of adultery, offences under 377 and offences related to Weights and Measures have been taken away.
He said the crime against women which earlier were categorized as crime against body have now been categorized differently.
“Dealing with crime against women has been given precedence to the offences like murder, 307 and 304. The Legislature has given it a legal recognition that women will have equal protection of law. Aspirations of the women have been taken care of. Violence against women has been dealt with severely. There is provision of speedy trial,” Sanjay Parihar said.
He said the Indian Evidence Act has also been changed and usage of WhatsApp, email, Instagram and other modes of communication including video recording have been given legal recognition.
Meanwhile, as per an order issued today by Sanjay Parihar Judicial officers and senior Advocates have been nominated as Resource Persons for conducting the sessions from June 24 to June 29 on New Criminals Laws at New Layers Chamber Conference Hall, Jammu.
While today Parihar himself was the Resource Person, on June 25, Kamlesh Pandita, Additional District Judge (Commercial Cases) Jammu will be the Resource Person. Ajay Gupta, Principal Judge Family Court Jammu will be the Resource Person on June 26, Sunil Sethi, Senior Advocate on June 27, Deepak Sethi, Additional District and Sessions Judge Jammu on June 28 and TK Raina, Special Judge Anti-Corruption Jammu on June 29.
