Man sentenced to imprisonment in cheque bounce case

UDHAMPUR, Feb 11: A person was sentenced to imprisonment by a local court here for issuing cheque that was dishonored by the bank.
The court of Judicial Magistrate, Udhampur, Junaid Mir convicted and sentenced one Kartar Chand son of Kanwar Singh of Jakhani to imprisonment of one year and fine of double the cheque amount of Rs 1,60,000.
The court held that the defense of the accused seemed to be weak since the accused had been unable to rebut the evidence of the complainant which proved that a cheque in the name of the complainant was issued by the accused which got bounced for insufficient funds in the account of the accused. Further, Court held that considering the totality of the circumstances and evidence adduced, the complainant has been successful in proving the guilt of the accused on the touchstone of the provision under Sec 138 Negotiable Instrument Act.
The accused was hence sentenced to imprisonment of one year and fine double the cost of the cheque amount. The accused shall serve the sentence in District Jail Udhampur. The complainant during the trial was represented by Advocate Neeraj Gupta.
