Man awarded 3-year jail for cheating, forgery

Udhampur, Dec 26: A 31 year-old man has been awarded three year imprisonment by a Udhampur court for misappropriating cheque of Rs two lakh of Uma cement industry located at Battal Ballian Udhampur 10 years back . Accused was working as employee (Accountant) in the company.
Brief facts of the prosecution case was that, Sourabh Kumar Agarwal who is running the Unit of Uma Cement Industries Battal Balian Udhampur lodged a complaint at Police station Udhampur that one of his employee Kali Dass along with another person has withdrawn Rs two lakh from his account by forging the cheque.
After the investigation, an FIR, under Section 408/467/ 468/471/ 201RPC was registered against accused and later challan was presented before the Session Court . Total 12 witnesses were examined by the court.
During argument on quantum on punishment, Counsel for accused prayed for taking a lenient view and extending the benefit of probation of offender. On the other hand, Inderjeet Sharma, Public Prosecutor contended, that offences for which accused has been held guilty are against the society, and prayed for stringent punishment to the accused.
Principal District & Sessions Judge Udhampur Mohan Lal Manhas awarding sentence today said taking into account the mitigating circumstances projected by accused that he is rustic villager and has suffered the agony of long trial for 11 years, has never defied the process of law and is having responsibility of his deaf & dumb wife, and other family members and is the only bread earner of his family,
Taking lenient view accused was convicted and sentenced to undergo simple imprisonment of total three years. Accused was given 2 years imprisonment and fine of Rs. 2000 under Section 480 RPC , 3 years & with fine of Rs. 5000 under Section 467 RPC, 2 years and fine of Rs 2000 under Section 468 RPC, 1 year & with fine of Rs. 1000 under Section 471 RPC and 1 year and fine of Rs. 2000 under Section 201 RPC.
However, all the sentences shall run concurrently. Convict shall serve his period of sentences in Central Jail.
