SRINAGAR, July 15: Supreme Court today asked Government to look into the matter pertaining to detention of High Court Bar Association President Mian Abdul Qayoom in view of COVID-19 and granted time for filing of reply by next hearing of the case.
A bench of Justice Sanjay Kishan Koul and Justice Indu Malhotra while hearing the plea of Qayoom today challenging the verdict of High Court by upholding his detention asked the Solicitor General Tushar Mehta appearing for J&K Government to look into the matter in view of COVID-19 with his detention expired and apprise the court by next date of hearing.
Solicitor General while arguing the matter sought ten days’ time for filing of reply in opposition to the plea of Qayoom. He submitted before the bench that the appellant’s ideology is against the national interest.
For seeking time from the Solicitor General, appellant Qayoom’s counsel Dushyant Dave questioned if such delays were reasonable in the matter involving liberty of a person. He submitted before the bench that the appellant is old aged and has been in prison for about a year now. “The period of his detention stands expired and he continues to be lodged in prison especially during this pandemic”, senior Counsel Dave informed the court.
Since the Solicitor General has sought time for reply the court granted the same and ordered listing of the matter for further hearing on July 23.
