JAMMU, Apr 6: 2nd Additional Sessions Judge Jammu, Subash C Gupta today awarded life-imprisonment to CRPF Head Constable for killing his Deputy Commandant.
According to the prosecution case, on April 14, 2007, CRPF Head Constable Sukhan Seth shot dead his Deputy Commandant Naval Singh at airport where both were posted.
After hearing APP K A Qazi appearing for the State whereas Advocate O P Sharma appearing for the accused person, 2nd Additional Sessions Judge convicted Sukhan Seth for the commission of offence of murder.
“On consideration of his young age and other facts and circumstances of the case, it can be said that mitigating circumstances have overweighed the aggregative factors which resulted into sparing him from gallows”, the Court said, adding “certainly, he is required to be given a chance to repent and reform himself while undergoing life imprisonment, which is ordinarily considered till the life of the convict”.
“Heinousness and gravity of the offence as committed by the accused in the present case would be sufficiently avenged by imposing alternative sentence of life imprisonment. It is settled principle of law that imprisonment for life and fine is a rule and death penalty is an exception for commission of offence of murder punishable under Section 302 RPC”, the Court said and awarded life-imprisonment to accused.
