Life-imprisonment awarded to militant in murder case

JAMMU, Dec 31: Principal Sessions Judge Kathua, M K Hanjura today awarded life-imprisonment to Zakir Hussain alias Umar Faoorq, son of Ali Mohd of Malhar, who was involved in murder of one Mohd Farooq.
According to the police case, on July 26, 2005, complainant and her husband namely Farooq Ahmed and others were watching TV when militant Zakir Hussain entered into their house and asked Farooq Ahmed to come out for some conversation. Later, Zakir Hussain fired indiscriminately upon Farooq Ahmed with a pistol leading to latter’s death on the spot.
Accordingly, police registered a case and after completion of the investigation presented challan in the court of law.
After hearing Advocate Y C Katoch appearing for the accused whereas Public Prosecutor Ravi Kumar Gupta for the State, Principal Sessions Judge awarded life-imprisonment to Zakir Hussain for offence under Section 302 RPC. The Court also awarded three years RI on each count and fine of Rs 5000 under Sections 120 & 201 RPC. He has also been sentenced to undergo RI for a period one year under Section 404 RPC and fine of Rs 5000.
The accused will also undergo five yrs RI and fine of Rs 1000 under Section 25 Arms Act. The Court, however, further clarified that all the sentences will run concurrently.
“As provided under Section 374 of CrPC, the sentence of life-imprisonment imposed upon convict should not be executed unless confirmed by the High Court”, the Court said.
