KARGIL, May 23: Principal Sessions Judge Kargil, Tahir Khurshid Raina today awarded life imprisonment to three accused in a murder case.
While convicting the accused, the court observed, “this case is a clear example of a man turning beast on a petty issue”, adding “all the three accused who hail from Nepal went to the place of deceased to get kitchen utensils and on his refusal to return the same, they started beating him mercilessly with the hard objects”.
“Only the head was chosen by the accused and due to serious multiple injuries the victim died”, the court said, adding “this aspect is sufficient to infer intention of the accused to cause death”.
Principal Sessions Judge further observed, “this view of the court stands fortified by the various judgments of the High Courts of the country and Apex Court”, adding “a special reference in the case for convicting these accused was made to Virsa Singh’s case wherein it was held by the Supreme Court that even if the intention of the accused was limited to the infliction of the bodily injury sufficient to cause death in the ordinary course of nature and didn’t extend to the intention of causing death, the offence would be murder”.
With these observations, Court convicted three accused persons namely Keiser Bahadur, son of Dama Bahadur, Gopal Bahadur, son of Dhan Bahadur and Deep Bahadur, son of Sarjin Khatri, all the residents of Nepal.
Accordingly, court awarded life imprisonment with a fine of Rs 5000 each.
Public Prosecutor Manzoor Ali Khan appeared for the prosecution.
