Lay down maximum limit of vessels, boats that can be plied in Dal Lake: DB

JAMMU, Aug 5: Division Bench of High Court comprising Chief Justice Pankaj Mithal and Justice Wasim Sadiq Nargal has directed the Chief Engineer to lay down the maximum limit of such vessels/boats that can be plied and used in a particular lake especially in the Dal Lake.
This significant order has been passed in a petition mentioning that the petitioner had applied for grant of license to ply Jet-Ski, Paddle Boats, Water Ball and Water Boat in the Nehru Park area of the Dal Lake but the same has not been considered by the respondents.
The DB observed that under the J&K Water Resources (Regulation and Management) Act, 2010 and the Rules, the Chief Engineer, Irrigation and Flood Control Department, is the licensing authority to grant permission to ply a boat or vessel in any water course including Lakes and Ponds.
“We are of the opinion that the Chief Engineer has to first lay down the maximum limit of such vessels/boats that can be plied and used in a particular lake especially in the Dal Lake and thereafter, if necessary, to consider the application of the petitioner for grant of license in accordance with the law and the necessary guidelines depending upon the ecology and other ancillary things in connection thereto without violating the order of the High Court or any other Court”, the DB said.
