Lack of evidence leads to acquittal in 35 yrs old murder case

BARAMULLA, Nov 18: Principal Sessions Judge Baramulla Sanjeev Gupta today decided 35 years old murder case by acquitting three accused for want of credible evidence.
As per the prosecution case, one Habibullah Bhat went missing on the intervening night of 6/7 November, 1986 from his house situated at village Watapora of tehsil Bandipora. Later, the decomposed and mutilated body of Habibullah Bhat was recovered.
During the course of investigation, it came to the fore that the deceased was having extra-marital relations with one of the accused who along with her husband and brother hatched a conspiracy which led to the brutal murder of Habibullah.
After hearing Public Prosecutor appearing on behalf of the State and counsel for the accused, Principal Sessions Judge observed, “as per evidence tendered in the case, the prosecution was not able to prove the motive behind the murder of deceased by the accused”.
“The recoveries made at the instance accused were also held to be planted in order to frame the accused in the crime”, court said, adding “prosecution has not been able to prove its case beyond a reasonable doubt”.
Accordingly, the accused were acquitted.
