JSM for revocation of Article 350-A

JAMMU, Jan 2: Alleging that Article 350-A is against the basic structure of the Indian Constitution that guarantees equality to all the citizens of India, Jammu State Morcha (JSM) has demanded the Government of India to revoke the Article, which the Party said was added in the Indian Constitution mysteriously and illegally as appendix-II on May 1954, simply by a proclamation of the President of India without taking the parliament into confidence.
“The Article 35-A paved the way for the Constituent Assembly of J&K State to incorporate in the State constitution the sections 6, 8, and 9, thereby defining which Indian citizen can be a permanent resident of the State that can enjoy its citizenship rights”, JSM said in a meeting held here on Wednesday.
The meeting which was chaired by Party president, Prof Virender Gupta, maintained that these are unique clauses not found in any of the countries throughout the world and violate human rights and the basic rights granted in Indian Constitution.
“This article which was enforced unconstitutionally needs to go as it is responsible for the discriminatory treatment to the women of the State and the West Pakistan refugees”, Gupta asserted, adding the Congress party which pretends repeatedly for providing justice to the women folk and West Pakistan refugees has the moral responsibility to revoke 35-A clause from the constitution of India to undo the mistake that it has committed in 1954.
The meeting also asserted the State Government to incorporate in the State Constitution the fundamental rights as provided in the Indian Constitution and also the words “Secular” in its preamble.
The Party also demanded to declare Hindu, Shia Muslims, Bodh, Sikhs, Christians and Jains as religious minorities and provide them the privileges as being enjoyed by the minorities in rest of the country.
