Italian Marines case: SC allows accused Girone to walk free

NEW DELHI : The Supreme Court today said one of the Italian marines, Salvatore Girone, under investigation in Indian embassy for the killing of two Indian fishermen is free to go to his native country, Italy, while the international arbitration into the case is ongoing.
“We allow the application of Girone,” a two-judge vacation bench of the Apex Court, headed by Justice D Y Chandrachud and comprising Justices Prafulla C Pant, said in its order.
Girone, who has been living in the Italian embassy in Chanakaypuri in the National Capital, was one of the two marines along with Massimiliano Lattore, arrested in February 2012 on suspicion of killing two Indian fishermen in Kerala during an anti-piracy mission on an Italian oil tanker, Enrica Lexie.
The other marine, Lattore, is already back in Italy till September 30, after suffering health problems. It was ordered by Supreme Court for Lattore to stay in Italy.
The Supreme Court ruled that Girone can return to Italy, while the United Nations Tribunal would decide on the jurisdictional issue between India and Italy.
