The Superintendent of Police Kupwara, Irshad Ahmad, told Excelsior that six of the accused have been arrested while hunt for the other two including a Central Reserve Police Force (CRPF) jawan is on to nab them.
A woman Amira daughter of Maqsood Ahmad Shah Shatmuqam, Lolab died mysteriously in February this year in her in-laws home after she was married to her cousin Naseer Ahmad Shah of Malgund, Lolab in district Kupwara against her wishes.
Earlier, charge-sheet filed by the police had held her lover, Wikar Ahmad Khan, and his relatives of village Cheepora, Lolab responsible for her murder. Amira had married to Khan secretly without knowledge of her parents.
Amira died mysteriously in February this year when Wikar Khan and his relatives accompanied by a police party raided the house of Naseer Ahmad Shah in Malgund, Lolab to restore the possession of Amira to Wikar.
Amira’s father and her in-laws had held Wikar and his relatives responsible for Amira’s death. They deposed before the police that she died of heart attack when Wikar’s relatives raided house of Naseer Shah of Malgund.
A Special Investigation Team (SIT) of Police investigating the case filed a charge-sheet on April 23 this year had held Wikar Ahmad Khan and his relatives responsible for the death of Amira. The charge-sheet was filed on the basis of the statements of the victim’s family and relatives with waiting FSL report.
The FSL report of the case that was produced before the court in August this year revealed that the victim died of poisoning and ruled out heart attack.
The Trial court ordered the formation of the new SIT after the FSL report and Superintendent of Police Kupwara formed a SIT headed by DSP headquarter Kupwara on August 28 this year.
The SIT charge-sheet filed before the Principal Session’s Judge Kupwara today revealed that father and relatives of Amira had given false statements to the police on the basis of which they had filed the earlier charge-sheet.
Police had registered an FIR (No 07/2012 U/S 302,342,120-B RPC of P/S Lalpora) in the killing of Amira.
The new charge-sheet filed before the court reveals that the victim was in love with Wikar and had secretly performed Nikkah ceremony on October last year.
“Family of Wikar had sent the proposal of marriage of Wikar Ahmad Khan with Amira to her father that was rejected on the ground that of caste difference”, adds the charge-sheet.
The charge-sheet says that Amira had gone to the residence of brother in-law of Wikar, Farooq Ahmad Khan on February 12 this year but was sent back by Wikar’s family and was handed over her father Maqsood Ahmad Shah.
The charge-sheet says that soon after she was handed over to her father, Shah married off Amira to her cousin Naseer Ahmad Shah of Malagund, Lolab against her wishes.
The charge-sheet reveals: “Both advocate of victim gave false testimony before the Molvi who solicited the Nikah and in fact the girl did not give her consent. The victim was forcibly sent with her husband Naseer and was accompanied with one Abdul Hamid Shah of Shortmuqam Lolab, Nazir Ahmad Pir of Madmadve Kalarooch and Amira’s brother Nawaz Ahmad Shah. They were sent by Amira’s father Maqsood Shah in order to keep an eye upon her activities. The trio stayed in the house of Naseer Ahmad Shah to keep an eye on Amira.”
The charge-sheet further says that when Wikar knew about Amira’s forcible marriage he approached Sogam court and later Police Post Khurhama, Lolab for relief.
The charge-sheet says: “Abdul Hameed and Nazir Ahmad along with father of Amira hatched a conspiracy on February 16 to poison Amira after they found that she may be handed over to Khan. She was given diazepam and later Nivon that led to her death.”
