Hold fresh elections in J&K: Bhim Singh

NEW DELHI, Jan 14:  Chief patron of National Panthers Party  Prof Bhim Singh today urged upon the President of India, Pranab Mukherjee  to invoke Section 53 of the Constitution of Jammu and Kashmir and Article 174 of the Indian Constitution to dissolve the Legislative Assembly of J&K so that fresh elections shall be held by September this year.
Prof Singh in a  memorandum to the President urged him to intervene with in the power vested in him by the Constitution of India and State Constitution.  The President enjoys full powers and does not need opinion of the Central Government in this regard by virtue of Article 370 of the Indian Constitution, though it is a temporary.
Prof Bhim Singh submitted to the President that Jammu and Kashmir is integral part of Union of India and Article 370 turned infractuous after  August 20, 1952 when the State Constituent Assembly under the leadership of Sheikh Mohd Abdullah abolished monarchy.  The continuation of Article 370 is violative of fundamental rights of the people of Jammu and Kashmir who are citizens of India.  The President of India should exercised his constitutional power to declare Article 370 as infractuous.  Prof Bhim Singh said that Article 370 was inserted in the Constitution of India in 1950 on the instruction/prerogative of Pt. Jawahar Lal Nehru who intended to keep console over the powers of the then ruler of J&K, Maharaja Hari Singh.
Prof  Singh,  strongly argued for President’s intervention in J&K to save the State  from further destruction and discrimination by holding fresh elections with a clear message of reorganizing the State  through the establishment of a confederation of Jammu State and Kashmir Valley State with common High Court and one Governor.  He said  the people of Ladakh should be given option to choose between Union Territory or either of the States.
