HC upholds 7 yrs RI in attempt to rape with 5 yrs old girl

JAMMU, Nov 10: State High Court has upheld 7 years imprisonment and fine of Rs 27000 to Ashwani Gupta, who was involved in kidnapping and attempt to rape with five years old girl.
The incident took place on November 29, 2010 in Badyala Chak area under the Akhnoor Police Station and accordingly a case under Sections 363 and 376 RPC was registered. After completion of investigation challan was presented and charges under Sections 363, 376 and 511 was framed against the accused.
After completion of the proceedings, Trial Court awarded seven years rigorous imprisonment and fine of Rs 25000 to Ashwani Kumar. Against this judgment, the accused filed appeal before the High Court.
After hearing Advocate DS Saini for the accusecd and Government Advocate Sanjeev Padha for the State, Justice Janak Raj Kotwal observed, “the judgment rendered by the Trial Court does not suffer from any error or infirmity calling for interference by this court”.
Accordingly, High Court dismissed the appeal.
