HC stays Special Tribunal order, directs BOCA to seal house

SRINAGAR, Nov 4: High Court has stayed the order passed by the Special Tribunal and directed the Building Operation Controlling Authority (BOCA) to seal the house of one Ghulam Mohd Mir.
The Special Tribunal vide order dated February 14, 2019 while allowing the application filed by Ghulam Mohd Mir had compounded the major violation at the rate of Rs 20 per square feet which amounts to Rs 19,920.
The order of the Special Tribunal was challenged by BOCA before the High Court and Justice Ali Mohammad Magrey, after hearing both the sides, stayed the order passed by the Special Tribunal Srinagar and directed BOCA to ensure sealing of the house with the help of the Police and report compliance.
SSP Srinagar was directed to provide assistance required for ensuring such sealing. “The house shall remain on the Superadnama with the Divisional Commissioner, Kashmir, who shall appoint the competent officer to take over the possession on sealing by making all the inventories of the moveable and immoveable property inside the house”, High Court directed.
