HC stays Govt order on transfer of Dr Mohan Singh

JAMMU, July 3: State High Court has stayed the Government order whereby Dr Mohan Singh was transferred from the post of Mission Director, National Health Mission J&K.
As per the case before the High Court, by Cabinet Decision No.118/09/2015 dated August 21, 2015 Dr Mohan Singh was transferred and posted as Mission Director, National Health Mission. However, vide Order No.207-HME dated March 23, 2018, Dr Mohan Singh was directed to report to the administrative department for further posting and Dr Yashpal Sharma, Registrar (Academics), Government Medical College Jammu was transferred and posted as Mission Director National Health Mission vice Dr Mohan Singh.
The grievance of Dr Mohan Singh was that since he was posted as Mission Director National Health Mission by virtue of a Cabinet decision in the interest of administration and applicable law and rules governing the field, the Government Order No. 207-HME dated March 23, 2018 was issued by an incompetent authority.
“There appears to be substance in the contention of the petitioner. Therefore, it is directed that subject to objections and till next date of listing before the bench the operation of the impugned order No.207-HME of March 23, 2018 shall stay”, Justice M K Hanjura ordered and issued notice in the main petition as well as in Miscellaneous Petition returnable within a period of two weeks.
Meanwhile, in the light of the High Court Dr Mohan Singh has assumed the charge of Mission Director, NHM J&K.
