JAMMU, July 1: Justice Janak Raj Kotwal of J&K High Court Jammu Wing today in a petition filed by Dr Ankush Jasrotia challenged engagement of private respondent Dr Ravinder Kumar Bhagat, as Registrar/Tutor in the Department of Conservative Dentistry in the Indira Gandhi Government Dental College and issued notice to Commissioner/ Secretary Health & Medical Education J&K, Principal Indira Gandhi Government Dental College and private respondents returnable within four weeks.
Justice Janak Raj Kotwal after hearing Adv Abhinav Sharma appearing for the petitioner ordered that subject to objections and till next date before the Bench, engagement of respondent No. 3 as Registrar/Tutor, department of Conservative Dentistry in the Indira Gandhi Government Dental College, Jammu, shall stay.
Petitioner is aggrieved by the engagement of Dr Ravinder Kumar Bhagat, as Registrar/Tutor in the Department of Conservative Dentistry in the Indira Gandhi Government Dental College, Jammu notified vide notice issued on 19.06.2014 pursuant to the Advertisement Notice issued under endorsement No. IGGDCJ/Estt./GD/232-43 dated 19.05.2014, mainly and inter alia for the reason that it contravenes conditions No. 6 & 7 of the Advertisement Notice, which debars a Doctor having already worked as Registrar/ Demonstrator/ Tutor from appointment pursuant to the said notice. In support, the petitioner has produced copy of the order issued by the Director, Health Services, Jammu dated 11.01.2008, whereby at the time of his earlier engagement private respondent Dr Ravinder Kumar Bhagat was relieved for joining as Registrar/Tutor. Likewise, petitioner is also aggrieved of the appointment of private respondent Dr Rudra Koul on the basis of his superior merit.
