HC stays CEC Kargil election

JAMMU, July 16: State High Court today stayed the notification issued by Chief Executive Officer-cum-Deputy Commissioner Kargil whereby directions were issued for conduct of election to the post of Chairman-cum-Chief Executive Councilor of Ladakh Hill Development Council Kargil on July 18.
The order was passed in a petition filed by Mohd Haneefa Jan, presently Chairman of the Hill Council and others seeking stay on operation of impugned SRO-228 dated July 5, 2016 and order dated July 8, 2016 whereby powers of the Chairman have been freezed and directions issued for conduct of election to the post of Chairman/CEC.
Advocates Pranab Kohli, Farhan Mirza and Rahul Sharma appearing for the petitioners submitted that order impugned dated July 8, 2016 directing to conduct the elections on July 18 is in contravention of Section 27(2) of the Ladakh Autonomous Hill Development Council Act, 1997.
After hearing counsel for the petitioners, Justice Tashi Rabstan issued notice to the respondents and in the meanwhile directed that subject to objections from other sides and till next date of hearing, order impugned dated July 8, 2016 shall remain stayed.
