HC stayed written interview of Prosecuting Officer

JAMMU, Feb 6: The State High Court has stayed the written interviews of Prosecuting Officers to be held on February 8 in view of the bad weather conditions.
In a petition filed by Reyaz Ahmed Khan and Ors Hail from Kargil and Leh districts who had applied for the post of Prosecuting Officers stated that the notification prescribing the date of written examination was issued on 23.01.2015 whereby the date for conduct for written examination has been fixed as 08.02.2015. Two centres have been identified one at Jammu and other at Srinagar. It is stated that on account of the fact that the connectivity between the Leh and Kargil to the cities of Srinagar and Jammu are badly affected on account of weather conditions during winter season, it is impossible for the petitioners to appear and face the written examination on the date fixed by the respondents.
It is stated that even boarding a flight from Leh to Srinagar or Jammu is a difficult task to accomplish on account of long waiting list of passengers. It is stated that it is not possible for the petitioners to ensure their presence for appearing in the written examination on the date prescribed on account of the connectivity problems between two stations.
Justice Dhiraj Singh Thakur of J&K High Court Jammu Wing after hearing Advocates Anuj Malhotra and Amarveer Manhas appearing for the petitioners observed that It is true that the regions of Leh and Kargil are one of the remotest areas in the State of J&K. It is also a matter of common knowledge that during Winter season when highway gets blocked, it is only through air travel that the people can travel between Leh and Srinagar or Leh and Jammu. In these days of extreme weather conditions even the air traffic is badly affected and in such circumstances to allow the respondents to go ahead with the process of selection would necessarily imply keeping the people of this remote region completely out of the zone of consideration and issued notice to respondents returnable within two weeks and  ordered that Subject to objections and till next date before the Bench, it is ordered that no written examination for the post of Prosecuting Officer scheduled to be held on 08.02.2015 shall be conducted till further order.
Later the PHQ issued an order stating that the date of written examination for prosecuting officers to be scheduled on February 8 has been postponed and new date will be notified separately.
