HC seeks report on regularization of daily wagers

SRINAGAR, Oct 23: High Court has sought compliance of its directions passed with regard to regularization of daily wagers of High Court and District Judiciary as the Supreme Court had granted three months time to parties to settle all the issues.
“An adjournment is requested by B A Dar Sr AAG to apprise this Court with the steps taken to ensure compliance of the order dated 15.3.2018. The same shall be positively done before the next date of hearing”, Division Bench of Chief Justice Gita Mittal and Justice Rashid Ali Dar directed.
While disposing off the SLP filed by the State Government, Supreme Court had granted three months time to the parties for that purpose and had made it clear that in the event of any outstanding issue with regard to the subject matter upon expiry of three months, then it would be open for High Court to deal with the same in the petition pending before it, in accordance with law.
It may be mentioned that the State Government had moved to Supreme Court against the order of High Court dated 15.3.2018 whereby Commissioner Secretaries of Law and Finance Department were directed to remain present before the court to explain as to why of the court orders are not being implemented and explain their failure.
Court on March 15 last year had said that the orders of this Court are either misunderstood or are deliberately and intentionally not being complied with. Despite there being a clear direction for delinking of the daily wagers of the Judiciary i.e. High Court and the District Judiciary, the respondents are still mixing them with the daily wagers of other Government departments..
It may be mentioned here that Supreme Court earlier in SLP filed by the Government against DB order of High Court observed that Government is responsible for creating situation of recruiting persons on daily wage basis on large scale.
