HC seeks personal appearance of Principal GGM College

JAMMU, Aug 22: Taking serious note of blatant interference in the course of justice, High Court today directed Prof Nutan Resutra, Principal GGM Science College Jammu to remain present before the court on next date of hearing.
The direction was passed in a number of contempt petitions filed by Samiksh Suri and others against Higher Education Department and Principal GGM Science College, who had been directed by the High Court for maintenance of status-quo regarding petitioners status vide ad-interim directions dated July 16, 2013.
When the petitions came up for hearing, Advocate D S Chauhan submitted that petitioner working as Lecturer on contractual basis with effect from September 03, 2008 sought quashment of Section 3 (b) of J&K Civil Services (Special Provisions) Act, 2010 in so far as the said provision excludes the employees appointed in academic arrangement from their right of regularization of their services being ultra virus the Constitution of India especially when the candidates appointed on ‘academic arrangement’ are recruited and selected on merit through a fair and open process set out in the recruitment, selection and appointment procedure.
“The ad-interim directions passed by High Court were conveyed by the petitioner to all the respondents”, he said, adding “Nutan Rasutra, who is a head strong person and with prejudiced mind, in order to teach a lesson to the petitioners for having taken resort to writ jurisdiction, directed concerned Principals of the colleges, not to allow the petitioners to mark attendance and assign any class work with effect from August 1, 2014”.
“The petitioners when resented the defiance and dis-respect to the ad-interim directions dated July 16, 2013 passed by High Court, the Principals instructed the petitioners to seek further instructions from the Prof Nutan Rasutra, Principal Government Gandhi Memorial Science College, Jammu”, he said.
After hearing Advocate DS Chouhan, Justice Dhiraj Singh Thakur issued notices to respondents. Deputy AG Shaishta Hakim accepted notices on behalf of Prof Nutan Rasutra, Principal GGM Science College, Jammu (Nodal Officer) and Principals of concerned Colleges.
Justice Thakur also directed the Principal GGM Science College to appear before the court on next date of hearing.
