HC seeks explanation from SSB Chairperson for defying orders

Srinagar, Nov 3: High Court today sought explanation from the Chairperson Services Selection Board (SSB) for defying the court orders and warned Secretary of the Board for dealing wrongly with court orders.
The explanation from Chairperson SSB has been sought in a suo-moto cognizance on adulterated and substandard food supplied to the general masses by the food manufacturing units across the State.
Court on previous date of hearing had directed the Chairperson Services Selection Board (SSB) to complete the selection process of several posts for food testing laboratories of Kashmir as well as Jammu Division by next date or appear in person before the court.
Chairperson was not present before the court instead an application was moved for exemption from personal appearance. The application was not moved by the Chairman but by the Secretary of the SSB.
Court took strong note of the act of Chairperson for taking the court orders lightly as the officer was required to file the exemption application by herself and not through some other person with sufficient grounds. Accordingly, High Court warned Secretary SSB against such kind of practice in future.
Division Bench of Justice MH Attar and Justice Ali Mohammad Magrey after perusal of the exemption application said there is no satisfactory ground urged in the application for non-appearance before the court. “In the application it is stated the applicant (Chairperson) is at present out of station because of personal urgency and is not in a position to attend the court in person. Nothing is stated as to what was personal urgency”, reads the order of DB.
The court has expressed its serious concern over the non seriousness of Services Selection Board over delay in advertising and making selection of the posts as such directed the Chairperson of the Board to complete the selection process of the posts.
The DB was earlier informed by the Controller Drugs who was present in the court that the posts have been referred to the SSB almost one year back, but SSB has not made any selection till date.
Court also directed the authorities to report the court about the setting up of appellate authority both at Srinagar and Jammu and directed the concerned to constitute these authorities before the next date and report compliance to the court.
Court also directed Managing Director Medical Supplies Corporation to remain present before the court on next date. He was required to inform the court with regard to steps taken for procuring necessary equipments for setting up of two food testing laboratories one each at Srinagar and Jammu.
