HC seeks appearance of Director FCS&CA

Srinagar, Mar 10: The High Court has directed the Director Department of Food, Civil Supplies and Consumer Affairs (FCS&CA) Kashmir to remain present on Monday along with records pertaining to the case and explain as to why the judgment is not being implemented.
Justice Ali Mohammad Magrey passed the direction in a contempt petition for enforcement of judgment passed way back in 2014 whereby Court had directed the respondents to accord fresh consideration to the employees of the department for the post of Tehsil Supply Officers and Inspectors.
The consideration for petitioners as per the judgment would be included for those who belong to districts of Leh and Kargil in the relevant scale of pay for promotion to the posts of TSOs and Inspectors on the basis of their seniority as envisaged by the Rules.
Respondents on notice from the Court while filing statement of facts, submitted that they have implemented the final judgment. However, Court said, they joined issues with regard to two petitioners on the ground that they have been initially appointed after the commencement of Ladakh Autonomous Hill Development Council and have been promoted to the next higher grade by the DPC by the Deputy Commissioner, Leh.
Authorities in their reply submitted that the petitioners have not been incorporated in divisional level seniority of storekeepers as such they are not similarly situated with the other petitioners.
Court has already made it clear that there is no scope for the authorities to join issues with reference to merits of the case in contempt petition as such court in its earlier order observed that the Director has committed the contempt of court.
