HC notices on postponing exams

SRINAGAR, Oct 30: The Jammu and Kashmir High Court today issued notices to the Government on a Public Interest Litigation seeking holding of examinations in Kashmir valley this year only. These elections were postponed to March next year by the Government.
The Division Bench of the Jammu and Kashmir High Court comprising Chief Justice MM Kumar and Justice Ali Mohammad Magrey while responding to a PIL filed by advocate Mohammad Ashraf Wani seeking direction to the authorities to conduct the exams in last week of October or in first week of November, issued notice to Government for filing of reply to the Petition.
The notices were issued to Commissioner Secretary to Education Department, Director School Education, State Board of School Education and Board of Professional Entrance Examinations and they were asked to reply to the PIL by or before November 10.
The petitioner prays that direction may be issued to the respondents to conduct the examination of students from Nursery to 9th Standard in the last week of October or first week of November and start the new session immediately and also conduct the examinations of 10th and 12th in the second week of November.
The petitioner further prays that authorities be directed to make the assessment of the loss to the schools and rebuild such schools on modern and scientific lines and provide them all such necessities so that quality education will be provided there.
The petitioner mentions that Education Department convened a meeting that was attended by Deputy Chief Minister, Commissioner Secretary Education and Director Education and all Chief Education Officers, where it was decided to conduct the examination in the last week of October and to this effect press release was also issued by the department but surprisingly a Cabinet decision was taken where exams were postponed till March, 2015. “It is most unreasonable and unfair and amounts to aggravating the pain suffered by the students”, the petition reads.
