HC issues notice to Govt over detention of Kamaal, others

SRINAGAR, Dec 23: High Court today issued notice and sought response within three days over the detention of National Conference leader Dr Mustafa Kamaal and leaders of Awami National Conference Muzaffar Shah and Khalida Shah.
Hearing an appeal challenging therein the Writ Court judgment, the Division Bench of Chief Justice and Justice Sindhu Sharma after hearing the counsel for petitioners issued notice to Government which has been accepted in open court by the State counsel B A Dar (Sr AA) and sought response to the plea taken by trio in their appeal.
Writ Court has dismissed the petition of all the three political leaders after the Government refuted the allegation that they (petitioners) are under house arrest since from August 5 when the Reorganization Act 2019 was passed in the Parliament.
Police has submitted two communication before the Writ Court which were addressed to Additional Deputy Commissioner, Srinagar therein that all the three political leaders named in the petition have neither been put under house arrest nor their liberty has been curbed or jeopardised.
Writ Court while dismissing their petition had granted them liberty to prove their house arrest before the appropriate forum by filing appropriate proceedings.
Counsel for appellants submited before the Court said that the authorities have mislead the court with regard to present position of the appellants as neither they are being allowed to move outside nor anybody is being allowed to meet them.
