JAMMU, June 9: In a Public Interest Litigation (PIL) filed by Educational Environmental Social Sports and Cultural Society regarding implementation of AYUSH systems of medicine to strengthen the public health system, Division Bench of State High Court comprising Justice Virender Singh and Justice Dhiraj Singh Thakur today issued notice to Chief Secretary and others.
In the PIL, it has been submitted that AYUSH doctors are forced to prescribe allopathic medicines which is against norms and due to which the choice of treatment given to patients under one roof has been defeated.
“The SHRC has also taken cognizance of the matter in a complaint and directed the State Government to prohibit AYUSH doctors to prescribe allopathic medicines”, the petitioner said, adding “Principal Accountant General (Audit) J&K Govt Vide No SS/IT/2013-14/AM-22 dated February 25, 2014 observed that there was short fall of 90% in the release of funds by NRHM and the ISM Department has been functioning as employment generation unit rather to provide health facilities to the population by way of providing medicine/ drugs which the department has failed to provide”.
After going through the PIL, Division Bench observed, “this petition espouses a public cause” and issued notice to Chief Secretary, Commissioner Secretary Health and Family Welfare Department, Mission Director NRHM, Director ISM, Director Health and Family Welfare Jammu and Srinagar. The DB directed the respondents to file reply within four weeks.
Deputy AG Neeru Goswami accepted the notices for the respondents.
