Srinagar, Aug 30: High Court issued show cause notice for contempt of court to Director Local Fund Audit and Pensions for not implementing the court orders with regard to release of pensionary benefits to various retired employees.
The petition has been filed by various retired employees by agitating that despite retired from service they are deprived of their valuable right of pensionary benefits by the Director Local Fund Audit and Pensions J&K.
Justice Ali Mohammad Magrey said prima facie, the respondents have committed contempt of court and issued notice of show cause to the officers concerned. Meantime Court directed the authorities to ensure compliance of the order by releasing post retiral benefits in favour of the petitioners in tune with their entitlement as processed by the SMC and file compliance report before the court within two weeks.
Justice Magrey also directed the Commissioner SMC to ensure implementation of orders by taking up the matter with the Director Local Fund Audit & Pensions J&K. These retired employees allege violation of order passed on March 2018, in terms of the court on recording submission of their counsel qua entitlement of the petitioners for retaining the revised grade and for accord sanction of their pensionary benefit in the said grade.
The court had also in the said direction, stayed the communication of Deputy Director Local Fund wherein he had asked the SMC to recover the excess amount drawn by the retired officers. Counsel submitted before the court that the placement of petitioners in the higher grade is released in their favour from January 2014 by the SMC and confirmed by the Government in terms of the Government order which is misinterpreted by the respondents.
