JAMMU, Nov 27: In the much-publicized case of alleged double drawl of POL (Petrol Oil Lubricants) by the vehicles attached with Deputy Chief Minister and his staff, High Court today impleaded PRO of Deputy Chief Minister Prabhu Singh as party respondent.
The case took new turn when Prabhu Singh filed an application seeking his impleadment as party respondent in the petition filed by social activist Prof SK Bhalla.
After hearing Advocate Ritu Bharti vice Advocate JP Gandhi appearing for the PRO Prabhu Singh and Advocate Sheikh Shakeel Ahmed appearing for the petitioner, Justice Dhiraj Singh Thakur allowed the prayer made by PRO to Deputy Chief Minister and impleaded him as party respondent in the petition.
During the course of hearing, Advocate Ahmed pointed out that recently the Apex Court’s Constitution Bench has passed an authoritative pronouncement on FIR in which the Apex Court has directed that in cases of corruption, matrimonial/family disputes the police can initiate preliminary enquiry which should be completed within seven days.
He further submitted that the preliminary enquiry in the instant case was initiated in September 2012 and more than one year has been taken by the SVO and still the preliminary enquiry was incomplete. He sought appropriate directions to the State Vigilance Organization to apprise the High Court about the latest position of the enquiry particularly in the light of the recent judgment of the Apex Court.
Upon this, Justice Thakur directed the Registry to list the main petition on December 16, 2013.
