HC grants bail to LAHDC councilor in adverse remarks case

Srinagar, Sept 24: High Court today granted bail to LAHDC councilor implicated in case for making adverse remarks against the country, its leadership and against the Indian Army.
Justice Sanjay Dhar after forgoing reasons in petition of accused Zakir Hussain and accepted the same by admitting him on bail with certain conditions. Court while admitting on bail the accused said he shall furnish personal bond with one surety in sum of Rs 50,000 to the satisfaction of the court.
He has been directed to appear on each and every date of hearing before the trial court and shall not tamper with the prosecution witness and also not leave the territorial jurisdiction of Ladakh without prior permission of the trial court.
Court said that the case history reveals that immediately after the commission of alleged offence by the petitioner-Hussain has published an apology and expressed his regrets.
“This conduct of the petitioner subsequent to the commission of alleged offence, lends assurance against repetition of similar offence by the petitioner”, Justice Dhar observed.
He has approached the High Court under Section 439 of CrPc for enlarging him on bail in FIR No. 34 of 2020 for committing offences under section 124A, 153A, 153B, 505(2) and 188 of IPC registered with Police Station Kargil.
He had approached the Principal Sessions Judge Kargil by way of bail application but the same was dismissed on July 28 as such approached the high court for seeking his bail.
