HC grants bail to 3 in rape case

JAMMU, Mar 20: High Court today granted bail to three persons in the much publicized Channi Himmat gang rape case.
According to the police report, on 26.09.2016, prosecutrix filed a written report alleging that during the intervening night of 25/26th of September 2016, one Swarna Devi, wife of Ashok Kumar took her to her house at Channi Rama where she found three persons namely Sanjay, Jatinder and Bubby, who forcibly committed gang rape with her.
After the commission of offence, all the accused persons fled away from the spot after locking the prosecutrix in a room. On next day, prosecutrix managed to open the door and thereafter she filed the complaint. On this report, FIR No. 94/2016 for the commission of offences under Sections 376, 120-B RPC was registered and the investigation commenced. During the course of investigation, all the accused namely Sanjay Kumar of Akhnoor, Swarna Kumari, wife of Ashok Kumar of Qasim Nagar, Narwal were arrested.
After hearing both the sides in length, Justice Alok Aradhe observed, “it is not in dispute that the petitioners are in jail for the last more than five months and the investigation has been completed and charge sheet has been filed”, adding “there appears to be no need of their custodial interrogation”.
Accordingly, High Court granted bail with the direction that the petitioners shall remain present before the trial court on each and every date of hearing and they shall furnish personal bond in the amount of Rs 50,000 with one surety of like amount each to the satisfaction of Registrar Judicial.
