HC grants anticipatory bail to Kanta Andotra

Srinagar, Dec 7: High Court has granted bail in anticipation of arrest to accused involved in commission of offence with regard to wrong benefit of big chunk of land in shape of Orchard.
The counsels P N Raina with Asheesh Kotwal appearing for accused-Kanta Andotra argued before Justice Sanjay Dhar that allegations contained in the FIR do not disclose commission of any offence against the applicant-Andotra.
They also submitted before the court that the case of prosecution against Andotra that she was given wrong benefit of orchard land measuring 74 Kanals is without any merit. Referring the definition of orchard as contained in Agrarian Reforms Act according to which any area of land having fruit trees is an orchard.
Court after issuing notice to the prosecution for filing of response to the bail application, meantime granted bail in anticipation of arrest to the applicant-Andotra Court directed that in the event of arrest of the applicant in the FIR, she shall be released on bail subject to furnish the personal bond with one surety in the amount of Rs 50000 each to the satisfaction of the concerned Investigating Officer.
Applicant-Andotra has been directed to cooperate with the investigating agency and shall not temper with the prosecution witnesses as also shall not leave the limits of J&K without proper permission.
Court granted the liberty to investigating agency to withdraw the bail of applicant-Andotra in case she fails to comply with the condition as laid by the court. Petitioner counsel also informed the court that a case is pending on the issue before Assistant Commissioner Revenue, Kathua and without waiting for its outcome, the prosecution has registered FIR which according to the counsel for the applicant is a political vendetta.
