HC gives go ahead for Mayoral elections

SRINAGAR, Nov 24: The High Court today said democratic process cannot be made casualty and declined to stay and forestall the process of elections to the post of Mayor Srinagar Municipal Corporation scheduled to be held on November 25.
Justice Puneet Gupta while declining to grant interim relief of staying the process of elections said the petitioners are admittedly not the Councilors of the Corporation (SMC) and only claim to be the candidates in the by-elections to be held for Councilors from their respective Wards.
Court had yesterday after hearing the aggrieved persons through their counsel and advocate Momin Khan appearing counsel for SMC reserved its orders to the petition throwing challenge to the forthcoming elections to the post of Mayor SMC and announced its decision today.
Court said the contention of the petitioner counsel that the election for the Mayor should be postponed so that the petitioners have opportunity to participate in the election process of Mayor as they are contesting the elections for Councilors of the Corporation cannot be entertained.
“Looked from the angle, the contentions raised on behalf of the petitioners to stay the operation of the impugned notification and consequently the process for holding the election of Mayor cannot prima facie sustain in the eyes of law. The application filed for interim relief is dismissed being without merit”, Justice Gupta concluded.
Two persons from National Conference-Nuzrat Ara and Ali Mohammad Tantray, claiming to be contesting for Councilor in the by-elections of the Municipal Corporation, had filed the petition to challenge notification issued by the Secretary Srinagar Municipal Corporation Srinagar for the Mayor’s election scheduled tomorrow.
