HC for filling posts in CCIs

SRINAGAR, Feb 24: Expressing concern over not filling the posts for Child Care Institutions, the High Court today directed the authorities to take immediate steps for filling these posts and in default the Mission Director Integrated Child Protection should be present in the court.
Hearing the petition on protections and welfare of Juvenile Boards and Observations Homes in J&K Union Territory, the Division Bench of Chief Justice Gita Mittal and Justice D S Thakur directed the concerned authority to fill up all the vacant posts with utmost urgency and report the court on next date as also place the selected candidates before the court.
The Government counsel informed the court that the posts were referred to the Recruitment Board but some clarifications were sought by the board and the clarification sought by the board are responded by new Mission Director as the earlier incumbent has been transferred.
Court said the transfer and joining of new incumbent should not be an excuse in completing the process. The Selection Board through its Secretary in his report has submitted that the Mission Director ICPS forwarded a copy of syllabus for the posts of Programme Manager, Programme Coordinator, Manager Coordinator, Accountant, Data Analyst, Para-Medical Staff, Programme Assistant and Outreach Worker for conducting of written test.
Secretary of SSB informed the court that the issue was examined and based upon such examination, the matter was again taken up with the Mission Director ICPS, for furnishing some information which is awaited from the Mission Director. “As demonstrated there is no deliberate or intentional delay on part of the board in conducting the written test and the board has not slept over the matter but is pursuing the issue vigorously with the concerned”, read the SSB report.
This has been stated by the Secretary of the board in view of direction passed by the court to him to inform as to why the failure on his part for effecting the selection of the sanctioned posts be not treated as violation of the orders of court. It is almost one year ago when advertisement notice was issued for recruitment of 157 sanctioned posts in CCIs in J&K but no concrete steps were taken towards the finalization of the selection affecting the welfare of children as the staff is required to be positioned in CCIs in all the districts of J&K UT.
No steps as the status report revealed have been taken in terms of Rules of 89 and 90 of J&K JJ Care and Protection of Children 2014 for filling up the position of Chairperson despite lapse of several months. The Secretary Social Welfare Department has to inform the court about the steps taken in-terms of these rules for filling up the vacancy of Chairperson.
Report further indicated that Observation Homes are to be set up at Anantnag, Baramulla and Srinagar for girls. Similarly Observation Homes are being set up at Rajouri, Doda and Udhampur which have been projected before the Government of India but no time for operationalization and disclosure of dates has been mentioned.
The Court observed that strict view will be taken in case expeditious steps for filling up these vacancies are not undertaken. Court observed that the deficiency of the incumbents in these various positions be a strong impediment in ensuring the efficacy of the CCIs in J&K.
