HC dismisses plea challenging election of Karbalai

SRINAGAR, Apr 30: High Court dismissed the plea challenging the election of Congress leader Asgar Ali Karbalai as MLA to erstwhile J&K Legislative Assembly.
The election of Karbalai as MLA to erstwhile Assembly was thrown challenge by former PDP leader Anayat Ali. Karbalai was elected in 2014 Assembly elections from Kargil constituency.
Counsel representing the Election Commission of India submitted before the Court that the petition be dismissed as it has become infructuous with the afflux of time and in view of abrogation of Article 370 and creation of J&K as Union Territory. Karbalai’s counsel also admitted the position.
Justice Sindhu Sharma while dismissing the petition of Ali said with the dissolution of Assembly, the relief claimed by the petitioner cannot be granted, assuming that the issue of office of profit is decided either way that will not help the Ali, so there is no need to decide the issue.
“The petition has thus been rendered infructuous and is, accordingly dismissed”, court concluded.
