Srinagar, July 23: High Court today disapproved the Government order of appointment of Justice Hakim Imtiyaz Hussain(Rtd) as chairman of Fee Fixation Committee (FFC) for private schools.
It is after High Court warned the Commissioner Secretary Education Department to send him jail for defying the court orders with regard to appointment of chairman FFC that the Government today came with a copy of order before the court for appointment of Chairman FFC.
However, the Division Bench comprising Chief Justice N P Vasantha Kumar and Justice Hasnain Masoodi disapproved the appointment order as there was no mention of terms and condition in it about providing him man power, infrastructure, office, salary and making his office functional etc.
It has been brought to the notice of the court that earlier chairman Justice Bilal Nazki (Rtd CJ) resigned from the post as he was not provided adequate manpower, office and other things and again Government has appointed the chairman for FFC but facilities to the chairman has not been mentioned in the order. “Can’t give seal of approval to the appointment of chairman. Come up with clear stand”, court observed to Government counsel S A Naik (AAG).
Court also directed the state counsel to bring the entire file before the court as it wants to peruse it why one and a half month delay has been caused in appointing the chairman while court had granted week’s time for the exercise in July 1.
Court had sought personal appearance of Commissioner Secretary Education Department to explain his position why he should not be punished for dereliction of court orders.
