HC directs Vigilance inquiry into SMC retaining JE

Srinagar, July 21: High Court has directed the Commissioner Secretary GAD to conduct preliminary enquiry into the interest developed by the Srinagar Municipal Corporation (SMC) in retaining a Junior Engineer in the Corporation despite court orders.
Showkat Ahmad Matoo (Junior Engineer in Civil), who was transferred by the Government last year from SMC to I&FC Department after 10 years was not relieved by the Commissioner of SMC, G N Qasba.
Taking strong note of the lenient view of SMC over the transfer order passed by the Government, High Court directed Commissioner Secretary GAD (Vigilance) to conduct preliminary enquiry into the interest developed by the SMC authorities in retaining the JE who has been in the SMC for past one decade.
“Commissioner Secretary GAD (Vigilance) to conduct preliminary enquiry about the interest, respondent authorities have developed in retaining private respondent in their office,” directed Justice Ali Mohammad Magrey.
The court after perusal of the record observed that Showkat Ahmad Matoo (Junior Engineer in Civil) has remained for more than 10 years in City Drainage Civil Division SMC, Srinagar and it appears that Municipal authorities have developed interest in retaining him in Corporation.
The Court also directed that report with regard to assets of Matoo both moveable and immovable be submitted in sealed cover within two weeks.
Court also directed that Executive Engineer, City Drainage Civil Division SMC to ensure relieving of Matoo by tomorrow and report compliance.
Irshad Ahmad (Junior Engineer Civil) was transferred (Government order No. 314-PW (Hyd) of 2013 dated:12.11.2013)  from I&FC Department to City Drainage Civil Division, SMC, Srinagar vice Matoo who was transferred and posted in the office of CE I&FC Kashmir.
Ahmad joined the office of Commissioner SMC but being interested in retaining the services of Matoo, Commissioner SMC instructed Superintending Engineer Drainage Civil SMC, Srinagar not to relieve Matoo and withdraw all the correspondence made in this behalf.
