JAMMU, June 2: In a petition filed by Choudhary Rakesh Singh and others of M/s Choudhary Transport Company, Justice Bansi Lal Bhat of J&K High Court Jammu Wing today after hearing Sr. Adv DC Raina assisted by Advocate Anil Verma appearing for the Choudhary Transport Company, directed respondents to entertain the tender documents of petitioner and allow it to participate in the tendering process at all stages.
This direction has been passed in a petition; Petitioners’ firm is aggrieved of incorporation of various stipulations in tender documents by respondents which, it complains is aimed at ousting it from the tendering process. It is pointed out that in a previous litigation between the same parties; this Court has passed the order dated June 3, 2010 in OWP No.656/2010 for stay of conditions regarding forfeiture of earnest money and black-listing of petitioner.
Justice Basni Lal Bhat issued notice to Chief Secretary, Commissioner/Secretary Transport Deptt, MD SRTC, Jt Managing Director SRTC and General Manger (Load) SRTC returnable within four weeks and in the meanwhile Court directed respondents to entertain the tender documents of petitioner and allow it to participate in the tendering process at all stages.
