HC directs Govt to consider regularization of daily wager

Srinagar, Dec 14: High Court directed the authorities to consider the case of the petitioner for regularization of his services who is working as daily wager, in view of his discharging election duty during 1996 Assembly Elections.
Hearing the petition of one Shakeel Ahmad Sheikh seeking regularization of his services as assured to him by the authorities after discharging the election duty for 1996 Assembly elections, Justice Sanjeev Kumar while disposing of the petition finally asked the authorities to consider his case for regularization of his services.
“…I would like the respondents to consider giving relaxation to the petitioner and regularize his services as a onetime exception, if the same is permissible in law”, Justice Kumar said.
Petitioner was aggrieved of order No.345 of 2015 dated 28.08.2015, whereby his claim for regularization has been rejected. It is in terms of Government order No.639-GAD of 1996 dated 09.08.1996, sanction was accorded to the grant of certain incentives to the J&K Government Employees including Daily Wagers to be deployed on election related work in the Valley during the Legislative Elections held in 1996.
It was, provided in the Government order that the daily wagers working in Government, who have not yet completed the prescribed daily wage service of seven years for regularization on 31.03.1996 and who satisfactorily perform election duty in the Valley, would be considered for regularization in relaxation of condition of 7years’ service, after completing only two years of such service.
In view of the Government order petitioner-Sheikh volunteered to perform election duty and was deputed as such at Polling Station 23/12 Amira Kadal Constituency. Thereafter, he represented to the concerned authorities for regularization of his services in terms of Government Order. However, no decision was taken on the representation of the petitioner.
