HC directs Govt to remove deficiencies in orphanages

SRINAGAR, Jan 30: High Court today directed the Government to remove all the deficiencies in observation homes and orphanages immediately and ensure prescribed medicines are provided to the children.
Amicus to the PIL  and senior advocate Bashir Ahmad Bashir informed the High Court that the report of the department with regard to facilities available in observation homes are not adequate and do not meet the prescribed rules even there is shortage of medicines as well.
The Division Bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad Magrey directed the Government and Mission Director ICPS to ensure that all the deficiencies as pointed out by the amicus are removed before the next date of hearing.
DB directed the authorities to remove the deficiencies immediately and in-fact these deficiencies viz-a-viz rules Juvenile Justice (protection & care of children) Act and its rules should be removed whatever may be the reason.
Court has been informed that hospitals are near the orphanages and drugs are not being provided because they (authorities) are in arrears. “We are directing Government to ensure that all the deficiencies as pointed out by amicus, are removed before the next date of hearing”, DB said.
Advocate Bashir in terms of previous directions has submitted his suggestions for improving the conditions in observation homes and orphanages in the State.
Court on last date had directed to specify the requirements envisaged in Juvenile Justice Act for orphanages and directed for filing of fresh affidavit indicating there-in the plan of action to meet all deficiencies.
Commissioner Secretary was directed to file his affidavit by next date indicating there-in the action of plan to meet the deficiencies in Orphanage homes across the State.
