JAMMU, July 12: In a contempt petition filed by J&K Administrative Service (JKAS) officer Bumesh Sharma seeking implementation of judgment whereby his reinstatement was directed, High Court has directed the Commissioner Secretary, General Administration Department to file compliance report failing which rule of court would be framed against him.
After hearing Senior Advocate Abhinav Sharma for the petitioner, Justice Rahul Bharti observed, “as the Supreme Court has dismissed the Special Leave Petition (Civil) filed by the Government as such, this is now an end of road of excuses for the respondent to defer the compliance of the court judgment”.
“The respondent – Commissioner/Secretary to Govt, UT of Jammu and Kashmir, General Administration Department is left with no other excursion option except to come reporting letter and spirit compliance of the judgment passed by this court in SWP No. 2140/2015”, Justice Bharti said.
“The requisite compliance be reported in the case by the Commissioner/Secretary to Govt, General Administration Department on the next date of hearing, failing which rule of court would stand framed against the incumbent serving as Commissioner/Secretary General Administration Department”, High Court said and listed the petition for hearing on August 7, 2023.
