HC directs for security to Panchayat members after threat assessment

Srinagar, Jan 23: High Court has directed the security agencies to expeditiously after taking the security review of petitioners provide them security in accordance with law and in view of threat perception to them.
Hearing a petition jointly filed by two persons one of them to be the Panch of Gohlan Uri and another a nominated Sarpanch of J&K Pradesh Congress Committee, Justice Sanjay Dhar directed the authorities that a decision regarding level of security to be provided to the petitioners in accordance with the report of the Security Review Committee.
The court while disposing of the petition at its threshold also directed the decision of Review Committee shall be taken by the authorities preferably within a period of one month from the date the copy of the order is made available with them
Earlier last week an SMC Corporator and BJP worker had also approached the court for providing of adequate security in view of threat perception to him and the court after considering his matter had directed the security agencies to provide the security to him after taking into consideration the report of Security Review Committee.
The Panch from Uri submitted before the court that he was attached by some unscrupulous elements for being associated with the Congress Party and in this connection an FIR has also been registered with the Police Station Uri.
Other incidents and circumstances to buttress the contentions of petitioners that their life is under threat from antinational elements have been highlighted before the court. Court after these submission said, the security of an individual including a political worker is concerned, the same is to be enhanced or downgraded having regard to the threat perception of the individual.
Court, for assessing the threat perception of an individual said, the security agencies of the Government conduct a periodic review and take appropriate steps in accordance with recommendation of security review committee.
“This court in exercise of its writ jurisdiction cannot direct the Government to provide a particular level of security to an individual and the level of security to be provided to a political worker is the sole domain of the security agencies”, reads the order.
Court however, said that it is the constitutional obligation of the State to protect the life and liberty of the citizens. The security agencies court said are therefore, duty bound to protect the life of the petitioners as such the matter of security of the petitioners deserves to be considered by the authorities with all seriousness.
“….the petition is disposed off, with a direction to the respondents to make an assessment of threat perception to the life of the petitioners and while doing so, they shall consider the facts and circumstances highlighted in the instant petition”, Court concluded.
