HC directs DGP to constitute SIT for investigation of POCSO case

JAMMU, Feb 4: High Court has directed the Director General of Police to constitute a Special Investigation Team (SIT) for investigation of Prevention of Children from Sexual Offences (POCSO) case.
The direction has been passed in a petition filed by father of minor rape victim levelling allegations against the SHO.
After hearing counsel for the petitioner, Justice Ali Mohammad Magrey directed the Senior Superintendent of Police Kathua to provide protection to the minor rape victim and also her family and ensure that the justice is done in the matter.
Justice Magrey further directed that compliance report shall be filed by the Director General of Police by or before February 8, 2021 qua constitution of the SIT and providing protection to the petitioner and her family.
“This court does not feel it necessary to issue any other direction at this stage lest that may cause prejudice to the respondent but would leave it for the respondents to address the complaint and pass appropriate orders thereon”, Justice Magrey said.
The petition has been filed by father of minor girl (victim) through Advocate Anil Khajura seeking transfer of investigation of FIR No. 136/2020 dated 27.11.2020, registered at Police Station, Billawar under Section 363 of the Indian Penal Code and Sections 4 and 5 of the Protection of Children from Sexual Offences Act, 2012 to a Special Investigation Team headed by senior police officers for a de novo investigation and also to provide security/protection to the petitioner and her family in view of the facts and circumstances set out in the instant petition.
