Srinagar, June 1: High Court directed the Deputy Commissioner Kargil to decide the complaint with regard to encroachment of a big chunk of grazing land.
The petitioners claiming to be the inhabitants of panchayat halqa Gargardoo Kargil contended that the land as per the revenue record has been reserved for grazing purposes and some outside residents of the hamlet residing in Village Garkhone, which is situated about 15 to 20 kilometers away from the area of the petitioners, are trying to encroach upon the land in question by raising construction for commercial purposes.
Justice Tashi Rabstan while disposing of the plea said the petitioner-villagers have already approached the competent authority (Deputy Commissioner, Kargil) by filing a complaint which is stated to be pending before the concerned authority. “Therefore, I am of the opinion that before adjudicating the issue on merits, it is appropriate to first let the dispute with regard to land in question be adjudicated by the revenue authority i.e., Deputy Commissioner concerned”, Court said.
The court directed the Deputy Commissioner, Kargil, to decide the said complaint, after giving an opportunity of being heard to all the parties. “The parties shall be at liberty to re-agitate if they feel aggrieved of the orders that may be passed by the Deputy Commissioner on the complaint”, Court clarified.
Court has been informed that some private party is forcibly and illegally making preparations for raising construction giving it a religious colour and banking upon some entry in the revenue records in his name which they submit is in total violation of Sections 24 to 27 of the Land Revenue act and Standing Order 23-A.
They were seeking a direction upon respondent-authorities not to encroach upon kahcharai land which is being used by the residents of Panchayat Halqa Gar Gardoo Tehsil Kargil for grazing purposes situated in Mouza Gurkoon and to stop the commercial activities of laying bricks on spot.
The official respondents submitted by filing an affidavit before the court contending therein that as soon as the petitioners approached them complaining that some people of village Garkone have started making bricks on the land in question, the officials immediately stopped such activities and as on today, no such activities are being carried out.
The private respondents have contended that the land in question has been allocated in favour of the monastery for educational purposes for which a small school is proposed to be constructed for the welfare of poor students in continuation with the best modern education standards.
