JAMMU, July 12: In a contempt petition filed by Changaiz Ahmed and others, High Court today directed Deputy Commissioner Jammu, A K Sahu to appear in person on next date of hearing.
The contempt petition was filed against non-implementation of Court order dated March 3, 2011 whereby directions were issued to appoint petitioner on compassionate grounds.
Advocate S S Ahmed appearing for the petitioner submitted that despite being served the Court order, Ajit Kumar Sahu instead of complying with order dated March 3, 2011 delayed the matter as he was under transfer from Poonch to Jammu.
Upon this, AAG Ravinder Sharma submitted that he will ascertain from the present Deputy Commissioner Poonch whether the petitioner has been appointed in term of SRO 43 of 1994 and the order implemented as directed by the Court.
On this, Justice A M Magrey observed, “in view of the statement of AAG it has become clear that petitioner has not been considered and order dated March 3, 2011 is yet to be implemented by the present incumbent”.
Justice Magrey also considered the submission of Advocate SS Ahmed and impleaded Sajjad Ahmed Khan, presently holding the charge of Deputy Comm-issioner Poonch as party respondent in addition to Ajit Kumar Sahu. Accordingly, the Court granted two weeks time for filing compliance report and statement of facts on behalf of newly added respondent.
Justice Magrey also directed that Ajeet Kumar Sahu, presently holding charge of Deputy Commissioner Jammu shall appear in person before the Court and explain his position as to why he has failed to implement the order passed by the Court on March 3, 2011. He was granted opportunity for submitting an explanation before framing of rules for initiating contempt proceedings.
