HC directive to Vigilance in JKMSCL case

JAMMU, June 21: In a petition filed by Dr Yashpal Sharma, the then Managing Director Jammu and Kashmir Medical Supplies Corporation Ltd (JKMSCL) seeking quashment of FIR, Vacation Judge of High Court today directed the Vigilance Organization Jammu to continue the investigation but final report in the matter shall await further orders from the court.
Advocate Vikram Sharma appearing for the petitioner submitted, “allegation in the FIR that the Purchase Committee was not complete in the quorum is baseless in view of the fact that all the members and/or their authorized representatives of the restructured State Level Purchase Committee while scrutinizing and affirming the annual rate contract of the drugs put the same to tender”.
“The FIR contradicting the official records substantiates the petitioner contention that the FIR impugned is motivated and replete with malafide and extraneous considerations”, he further submitted.
After hearing counsel for the petitioner and Deputy AG Raman Sharma, the court directed the Vigilance Organization to continue the investigation but the final report shall await further orders.
