HC directive to Dean CUK

SRINAGAR, Dec 4: High Court today directed the Dean of Central University Kashmir (CUK) to inform it as to under what law the Centre for Public Interest Litigation and Legal Aid (PIL &LA) has been constituted.
The Division Bench headed by Chief Justice Pankaj Mithal while hearing the matter filed under PIL by the Dean of School of Legal Studies CUK through one of its students directed him to come forward and disclose clearly the nature of status of the institution.
Court also directed him to inform as to who is overall in-charge of the institution and under what provisions of law the same has been constituted. He has also been asked to inform why the head of the said Institute himself is not coming forward to institute the petition.
It is noted the PIL under ‘The Centre for Public Interest Litigation and Legal Aid, a constituent Institute of the Central University of Kashmir’ has preferred under public interest through one of its student.
Court has observed that the Dean or the Ex-officio Chairman of the Institute or any officer of the University has not come forward to file this petition.
Court said, the student has only been authorized to file and argue the petition on behalf of the Institute but he is not authorized to file the petition in the name of the Institute through himself.
“We direct the Dean School of Legal Studies (Ex-Officio Chairman), Centre for Public Interest Litigation and Legal Aid, to come forward and disclose clearly the nature and status of the aforesaid Institution”, court directed.
The petitioner seeks that the authorities be directed to provide every child with disability all such appropriate equipment required for the purpose of elementary education for the purpose of online classes
It is also added that a policy or scheme be framed in order to provide these children all consequential charges incurred to utilize the equipments.
