SRINAGAR, Nov 1: State High Court has denied bail to a baker, who had attempted to commit rape with a 5 years old girl at his shop in the month of April this year.
The accused Imtiyaz Ahmed Bhat, who was booked under Section 376/511 RPC at Police Station Safakadal, had filed an application for grant of bail before the court of 2nd Additional Sessions Judge Srinagar but the same was rejected on various grounds.
Thereafter, he filed bail application before the High Court but the same was also dismissed by Justice M K Hanjura on the ground that accused had committed beastly and a contemptible act.
“The statement of the girl child recorded under Section 164-A CrPC sends shivers down the spine of everyone. The accused, an adult blessed with children, has committed disgraceful and disgusting act with the girl”, Justice Hanjura observed, adding “the crime attributed to the petitioner is an abominable one. It is repugnantly hateful, detestable, abhorrent, atrocious, heinous and horrid”.
“The act has shaken the conscience of the society as a whole. The petitioner was of the age of her father and he tried to abuse her sexually. The statement of the girl child projects a tale of woes and it portrays the element of human degradation”, Justice Hanjura further observed, adding “the petitioner doesn’t deserve to be enlarged on bail taking into consideration the facts and the circumstances of the case”.
Accordingly, the High Court dismissed the bail application.
