Srinagar, Jan 13: The High Court has appointed a Commissioner to oversee and monitor the elections for Amar Singh Club Srinagar.
Justice Rahul Bharti has appointed advocate Khushnuma Chowdhary as Commissioner for supervising the conduct of elections and proceedings of the Club as the notice for elections has been questioned by some members of the Club.
“The election exercise shall be conducted by the Returning Officer appointed in the case and the Commissioner shall be apprised of the proceedings of the election by the Returning Officer”, Justice Bharti directed.
It has further been clarified by the court that the outcome of the elections shall be subject to the outcome of the case pending before the court. Court has fixed a Rs 50,000 fee for the Commissioner which the court said shall be paid by the Club.
The elections were questioned on the ground that the entire election exercise is illegal without mandate of the byelaws of the Club. Aggrieved members were seeking stay of holding elections and the court allowed for elections under the observation of Commissioner and the elections would remain subject to outcome of case.
That as provided in the constitution, Governor of Jammu and Kashmir is the ex-officio Patron of the Club and Chief Minister of Jammu and Kashmir is the President. Vice President of the Club is nominated by the President.
The management of the affairs and concerns of the Club is vested in its Managing Committee, which finds its roots in the constitution and as per the Constitution, the total strength of the Managing Committee 12 members excluding the President and the Vice-President; out of which eight members are to be elected by way of an elections and four members are nominated by the President from amongst the permanent members of the Club, for a period of two years. From amongst the members of the Managing Committee, a member is to be elected as Secretary of the Club.
