SRINAGAR, Aug 25: Government today informed the court that three member committee constituted for inquiry into fake certificate scam in the Indian System of Medicine has been withdrawn and one man inquiry has been directed to submit its report within a period of 15 days.
With this information and submitting the order of Government with regard to one man inquiry by Advocate General, the division bench of Chief Justice N P Vasanthakumar and Justice Hasnain Masoodi directed for keeping the report of ‘earlier committee’ intact and file report of new committee with two weeks.
The Government Order NO. 345-HME of 2015 dated 24.8.2015 says that the committee constituted on 22.7.2014 is hereby withdrawn abinitio. “Consequent upon Special Secretary H&ME (Rajinder Singh Tara) is hereby directed to appoint as inquiry officer into and to submit a factual report of the case forming the subject matter”, reads the order.
The enquiry officer has been directed to conduct an exhaustive enquiry into the fact and submit his report within a period of 15 days from the date of issue of this order.
During the arguments of the case senior Advocate Z A Shah who is representing Director ISM, Dr Kabir Dar, stated before the court that there is negative reporting in the press about this case and as such they (Press) should be stopped. “They are writing probe ordered into fraudulent selection. Who says they are fraud selection”, advocate Shah submitted to the bench.
“See inquiry has been ordered let the committee file the report. It is the right of the media. We cannot ask press to report in this manner or that manner” court observed
Senior Advocate Bashir Ahmad Bashir who through the present PIL seeks probe be conducted into the selection of Pharmacist said press has freedom to expression. “If though I am not holding their brief, press people have freedom of expression” advocate Bashir told HC.
Shah made the request to the court to stop press from negative reporting. Court while denying his submissions observed: ”Inquiry is ordered and let the inquiry committee file the report.”
In is worthwhile to mention here that Government earlier had ordered enquiry about the issuance of Dawasaaz (Pharmacist) certificates by the Director ISM Dr. Abdul Kabir to the hundreds of persons and vide order NO. 277-HME of 2015 dated 22.7.2015 Government has ordered an exhaustive inquiry so that detailed reply be filed before the High Court in a PIL wherein it is alleged that Director ISM has issued Dawasaaz (Pharmacist) certificates to the hundreds of persons as none of them have ever been admitted in any college or institute for undergoing such training or ever having attended any classes or practicals or appearing in any test or examination.
As the court is seized of the matter about the issue of fake certificates and Government did not till date have come up with a clear stand before the court.
Petitioner is seeking Dawasaaz certificates issued by the Director and those which are lying in his record should be declared nullity further Director Vigilance be directed to register FIR against the Director ISM under section 5(2) of the PC act and till such time he(Director) be removed from the said post so that the record be protected.
